ASSUMPTION OF RISK, RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

IN CONSIDERATION for being permitted to play in the league or tournament, the undersigned hereby makes the following covenants, representations and warranties to the League and acknowledges and confirms that the League is relying upon such covenants, representations and warranties in connection with the issuance of permission to play in the League:

1. In light of the existing COVID-19 Public Health Emergency in New York State (“State”) team coaches will implement and enforce State mandated social distancing requirements as well as comply with all other State and local guidelines applicable to the safe conduct of sports play during the COVID-19 Health Emergency and the player (or Guardian) voluntarily assumes all risks related to the possible exposure to COVID-19 on behalf of the participant.

2. THE PLAYER HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE, the League, its officers, employees, volunteers and agents (collectively, the “Releasees”) from and against any and all liability to the undersigned for any loss or damage and any claim or demand directly or indirectly related to any injury, or an illness or death including, without limitation, losses, damages , claims or demands relating to the contracting of COVID-19 directly or indirectly arising out of, relating to or resulting from the League’s playing activities...

3. THE PLAYER HEREBY AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS the Releasees from and against any and all losses, liabilities, damages, claims, demands, actions, litigation's, judgments, suits, costs, disbursements expenses, including, but not limited to, reasonable attorneys’ fees and expenses (collectively, “Damages”) of whatsoever kind and nature, imposed upon, incurred by or asserted or awarded against any of the Releasees directly or indirectly arising out of, relating to or resulting from the Player’s playing activities in, including without limitation, those related to the contracting of COVID-19.

4. THE PLAYER further expressly agrees that the foregoing ASSUMPTION OF RISK, RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of New York and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.

The undersigned, a duly authorized representative of the League set forth below, has read and understands the terms of this Assumption of Risk, Release, Waiver of Liability and Indemnity Agreement and agrees, on behalf of the League, to its terms and conditions.
